Terms of Service

These Terms of Service ("Terms") govern your use of the Cuper desktop application, the cuper.ai website, and all related services (collectively, the "Service") provided by Cuper.ai ("Cuper", "we", "us", "our"). By using the Service, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using Cuper, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Cuper is a security tool that scans your device for AI agent configurations, detects potential security risks, and provides remediation guidance. The Service includes:
- Free Tier: Device scanning, agent detection, risk scoring, guided fix instructions, emergency freeze (config backup and restrictive rewrites), decision logging, and audit trail
- Premium Tier: All Free features plus one-click auto-fix, scheduled scans, remote device control, Cuper Guard AI, alerts for relevant config and score events, config backup vault, and more. Specific Premium features may change; the in-app upgrade screen and website list what is available at purchase time.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized account access
- You must be at least 13 years old to use the Service
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Reverse engineer, decompile, or disassemble the desktop application
- Attempt to gain unauthorized access to our servers or other users' data
- Use the Service to interfere with or disrupt other software or systems
- Redistribute, resell, or sublicense the Service
- Use automated tools to abuse our API or create fake accounts
- Circumvent rate limits or security measures
5. Premium Subscription
5.1 Billing
- Premium subscriptions are billed monthly ($11.99/month) or annually ($120/year) via Stripe
- Your subscription auto-renews unless cancelled before the billing period ends
- Prices may change with 30 days' notice
5.2 Cancellation & Refunds
- You may cancel your subscription at any time from your account settings
- After cancellation, you retain Premium access until the end of your current billing period
- We offer a 7-day refund policy for first-time subscribers who are not satisfied
- Refund requests should be sent to support@cuper.ai
6. Security Disclaimer
Cuper is a security advisory tool, not a guarantee of security.
- Cuper identifies known AI agent misconfigurations and risks based on heuristic analysis
- We cannot guarantee detection of all security vulnerabilities
- The "Fix" features modify agent configuration files on your device. While we create backups before changes, you acknowledge that configuration modifications carry inherent risk
- The "Emergency Freeze" feature modifies agent configuration files on disk to disable dangerous permission flags (with backup and restore). It does not terminate running processes or guarantee interception of every live agent action
- In-app "Block" decisions on individual findings record your intent and policy preference; they are not a guarantee of real-time enforcement against agent runtime behavior unless and until a separate enforcement feature is offered and enabled
- Cuper Guard AI provides general security guidance — it is not a substitute for professional security consultation
7. Intellectual Property
- The Service, including all code, design, branding, and content, is owned by Cuper.ai
- You retain ownership of your scan data and configuration files
- We grant you a limited, non-exclusive, non-transferable license to use the desktop application
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. Key points:
- Scans are processed locally on your device
- Data is only sent to our servers when you explicitly use sync features
- We never sell your data to third parties
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for damages caused by AI agents or their configurations — Cuper is an advisory and remediation tool
10. Indemnification
You agree to indemnify and hold harmless Cuper.ai from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
- You may stop using the Service and delete your account at any time
- We may suspend or terminate your account if you violate these Terms
- Upon termination, your right to use the Service ceases. Data deletion follows our Privacy Policy
12. Changes to Terms
We may modify these Terms at any time. We'll notify you of material changes via email or prominent notice on the website. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
